Your purchase of a product or service from Anvil Web Services Manchester is governed by these Terms & Conditions. Please read them carefully. Placement of an order indicates your acceptance of these Terms & Conditions of sale and our Terms for use of this site. Cancelling Your Order For a Service
If you wish to cancel your order we will refund you in full providing we receive confirmation of your decision to cancel by email or telephone before any work is commenced. Hosting services have an initial 30 day money back guarantee. There are no pro rata charges or refunds where monthly charges apply to a service(s). We reserve the right to refuse hosting services at any time.

There are very few circumstances where there will NOT be a refund. Those are where the payment method used was fraudulent &/or the use of the hosting does not conform as outlined under the heading Website Hosting Terms para 7 below.
Site files and databases
It is your responsibility to make regular backups of your site files, emails and databases. There are full backup facilities in your cPanel.
Automated Backups in cPanel
Every web hosting account comes with a fully automated backup system Jet Backup in cPanel. There will always be 28 days backups available & you can see from the following graphic what is available. We advise you to read the documentation, as highlighted, & familiarise yourself with the system.
Cancelling Your Order For a Download
Downloadable products are non refundable. If you have a problem or issue with any software or module please contact us within 24 hours of purchase.

Payments
All payments are securely processed by our secure online payments processor SquareUp. Acceptable forms of payment are only by Credit or Debit Card. Anvil Web Services Manchester DO NOT accept payment by any form of Cheque, Crypto Currencies, Vouchers, Money Transfer Services eg: Western Union, or by Direct Debit. We may accept payment by Direct Bank Transfer but that facility MUST be prearranged & is ONLY available to existing customers who are in good standing & without arrears. Website Hosting Terms
Please find toward the foot of this page Anvil Web Services Manchester Terms & Conditions for a Web Site Hosting service (the "Service") between Anvil Web Services Manchester and the Customer. The Customer being the person(s) or business that pays Anvil Web Services Manchester for the "Service". Anvil Web Services Manchester agrees to provide, the "Service" via the Terms & Conditions that follow. Please note that by purchasing our services and continuing to use them, you are agreeing to adhere to our Hosting Terms & Conditions below & you are responsible for making sure the service fits your needs required
These are the terms for our Website Hosting only plans.
Renewal Payments
To renew your hosting plan your payment must be received before 23:59 hrs before the expiry date of the package. Failure to make this payment prior to the expiry date will result in a system automated suspension of your account and may incur a reactivation fee, currently £15.00.
1. Anvil Web Services Manchester take no responsibility for any information loaded to you customer Website Hosting account(s) or web site(s). Where it is brought to our attention, and we deem the material to be inappropriate, we will suspend the customer’s service on account(s) or websites, until any illegal or inappropriate data is completely removed. Failure to remove any such material within 48 hours from the moment Anvil Web Services Manchester notify you via the contact methods we hold on file for you, will render the account fully suspended until we hear from you. Suspension includes that any website & or all email accounts will cease to be visible online and inaccessible. If contact has not been made by you within 5 days then a full service termination will take place & all files & emails held within your account will be fully deleted. NO REFUNDS WILL be available under these circumstances.
2. The customer will fully indemnify Anvil Web Services Manchester against liability (of any nature), which may befall Anvil Web Services Manchester as a result of the customers illegal use of our services provided to the client.
3. Refunds are only available, if the level of service provided to the customer by Anvil Web Services Manchester is determined as unsatisfactory by the staff of Anvil Web Services Manchester. No refunds are available if the customer wishes to cancel their account for any other reason. An administration fee of £30.00 will become due to cover bank administration & Debit / Credit Card charges.
Please note that any technical issues or problems that arise must be brought to Anvil Web Services Manchester attention immediately. Anvil Web Services Manchester must be permitted to use all reasonable efforts to rectify problems before a refund, where applicable, can be claimed or paid.
4. Customers shall not provide copyrighted materials without written authorisation from the respective copyright holder, provide obscene or offensive material (e.g. pornographic, homophobic, racist, terrorist, human harm, child exploitation), provide material whose nature & or volume compromises the ability of Anvil Web Services Manchester servers to serve other customers’ websites (those instances include but are not limited to unreasonable consumption of disk space, Internet bandwidth, CPU, & memory usage, as determined by Anvil Web Services Manchester staff), provide materials that are deemed by the government authorities as inappropriate, defamatory, degrading or illegal. Any such government determinations will be binding on the customer & not Anvil Web Services Manchester.
5. Where applicable, if you purchase a annual UK hosting plan with a free .co.uk domain name, you are only able to use that domain name with that hosting plan. If you require to use any other domain name with the hosting, then a fee of £25 is applied to make the necessary changes to assign the existing domain name to the new hosting space.
6. Free domain name renewal - Anvil Web Services Manchester will renew at our cost for the minimum renewal period, usually twelve (12) months, any free .co.uk domain name provided that the domain is assigned to a paid-up web hosting package as the “main domain” and that we receive an email request from you the customer to office [at] anvilweb [dot] com (which we must acknowledge) within four weeks of the domain renewal date. If such a request is not received we will take no action to renew the domain and it will become suspended thus rendering all email and web services suspended. If the domain name remains unpaid it will become de-registered and may be registered to any other party. Once a domain name has been registered by a third party then Anvil Web Services Manchester nor the client can reinstate the damain back to their custody. The customer will ensure they are listed as administrative email contact of the domain to receive renewal reminders from the registrar. Clients are solely and ultimately responsible for making sure their domains are renewed on time.
7. Anvil Web Services Manchester do not allow hosting of websites, including but not limited to the following content, adult, games, mobile phone tones or logos, computer games, celebrities, gambling, crypto currency, pre-paid cash cards, Warez, web sites owned by any customer under 18 years of age, sites with webcams or video content or ANY illicit substances.
8. Spamming or any type of unsolicited commercial or non-commercial email is 100% strictly prohibited, & the clients account will be fully suspended if you are found to be doing so. If we deem reactivating the account as not viable then any website files will be available to the customer but NO emails will be available.
If your email address is receiving abnormal amounts of email from one host, then your server will block the sending server as a security precaution against receiving spam and slowing the services down for other users. This is an automatic procedure that is in place by the web hosting system.
9. Monthly bandwidth allowance is stated as unmetered. However, if we feel that a customer is using excessive amounts of bandwidth, and is affecting the service we provide to our other customers, then we reserve the right to cancel your hosting package and in those circumstance you are not entitled to any refund of monies paid. Any sites running MySQL bulletin boards, message forums or Chat services are limited to 3GB of bandwidth per month. Additional bandwidth fees may be applied.
10. Bandwidth limits are put in place to make sure that our customers do not breach our Terms & Conditions. Within your cPanel you can enter an email address to advise you when your site is nearing its bandwidth. Please email office [at] anvilweb [dot] com when this email is received and providing the site stays within our Terms & Conditions we will increase the bandwidth. Usually the increase will be 10 - 20%
11. All disk space that is provided to Anvil Web Services Manchester hosting customers, must have only files that are used within the website. The server space cannot be used for file storage, online email IMAP accounts, or file sharing in anyway. If your account is found to be participating in any of the above, then it will be suspended without warning and additional charges may be applied.
12. Domain name only purchases are for registration only. Email and web forwarding are free services and are not part of the contract that you purchase when you buy a domain name. Anvil Web Services Manchester cannot be held responsible for redirection failures if the recipient mail servers will not accept email from our servers.
Please note that you, THE CLIENT, must ensure that when registering a domain name that the spelling is correct as once the registration has been accepted by the registrar this can not be amended. NO refunds or changes can be made.
13. It is advisable, that if you want to use forums on your web site, you use a php/mysql solution, there are many free forum programmes that can be installed. Perl or CGI forums are slow and inefficient. If Anvil Web Services Manchester deems necessary, the customer can be asked to remove their forums or asked to switch to a php/mysql solution.
14. Spam email is one of the major scourges of the Internet and is something we spend lots of time and money on trying to fight for our customers, but sadly it is something that we cannot stop. We have spam blockers running constantly on our email servers, but due to the fact that spammers constantly change the format of emails, it is impossible for all emails to be blocked.
Anti spam filters run on all of our hosting plans. You also have the added facility of Spam Assassin, which allows you to greatly help reduce the amount of spam that you receive.
15. Multimedia file types, limited in size to 5 MB, including but not limited to .mov, .avi, .mp3, .wav, .rm, .ram, .wmp, .zip, rar are permissible but sites using these file types will be monitored, and if Anvil Web Services Manchester deems necessary 4 and 7 above will apply. Any files over 5 MB in size are not allowed on our servers. Failure to adhere to this may result in suspension of your site with no prior warning.
16. Anvil Web Services Manchester is not responsible for any interruption of service, and accepts no liability for any loss of services, sales or any other form of loss.
17. Occasional discounts apply only to new orders and is not applicable for renewals.
18. Any website that has a usage limit over 5 GB will not be backed up automatically. Files include but are not limited to email, MySQL databases, web files etc. If you require your site to be backed up, please contact our office [at] anvilweb [dot] com for pricing.
19. Anvil Web Services Manchester reserves the right to terminate any accounts, at any time, where the user has made unreasonable or inappropriate use of any of the services supplied to the customer by Anvil Web Services Manchester, as deemed by our staff.
20. If domain names are not renewed within a specified time of 2 weeks after expiry, then Anvil Web Services Manchester cannot be held responsible for the loss of any domain name which has expired and been been purchased by a third party.
21. Any contracts that started before August 2009 and upgrade after will need to pay the additional fee for what the base plan now costs.
22. Usernames are set automatically for hosting accounts. It may be possible for you to have an alternative username, but this depends on various factors and availability. If so, then you will need to pay a one-off admin charge of £15.
23. Anvil Web Services Manchester email system allows you to setup any email address on your domain(s) as POP3 or IMAP. Setting up those is a personal choice and each one has it's pros and cons.
24. By purchasing hosting services from Anvil Web Services Manchester, you agree to receive periodic marketing material, usually no more that six (6 ) per 12 month period, including but not limited to email campaigns, newsletters, direct mail and telephone calls. These are for the sole purpose of keeping you up to date with Anvil Web Services Manchester latest news, special offers, promotions and service enhancements. You are free to opt-out of any of these communications at any time if you so wish. In each email you receive from us, there will be an Unsubscribe link. Your privacy is very important to you & Anvil Web Services Manchester – please read our Privacy Policy .
25. By purchasing an Anvil Web Services Manchester service, you are aware and agree that any refund that needs to be made to your account, due to over-payment, payments taken in error and 60 day money back guarantee payments can take up to 30 days to appear in your account. Refunds are repaid by card only as we only accept card payments via our website. Refunds will only be paid back to the card used on the purchase.
26. All upgrades are automated. It is the customers responsibility to make sure that they have purchased the correct upgrade as Anvil Web Services Manchester will be unaware of any incorrect upgrades. 27. Reseller Invoicing: Anvil Web Services Manchester currently no longer supply Reseller Services. Currently there is no intention for Reseller Accounts to become available in the future.
LIMITATION OF LIABILITY:
28. All conditions, terms, representations and warranties relating to the Services supplied under this Agreement, whether imposed by statute or operation of English law or otherwise, that are not expressly stated in these Terms & Conditions including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded;
28.1 Nothing in these Terms & Conditions shall exclude our liability for death or personal injury resulting from our negligence;
28.2 Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the Services shall be limited to the charges paid by The Client in respect of the Services which are the subject of any such claim;
28.3 In any event no claim shall be brought unless you have notified us of the claim within one year of it arising;
28.4 In no event shall we be liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever;
29. You, The Client, are solely responsible for ensuring the Services are renewed. WE SHALL HAVE NO LIABILITY TO YOU OR ANY THIRD PARTY IN CONNECTION WITH THE RENEWAL OR ANY ATTEMPT TO RENEW THE SERVICES AS DESCRIBED HEREIN, INCLUDING, BUT NOT LIMITED TO, ANY FAILURE OR ERRORS IN RENEWING OR ATTEMPTING TO RENEW THE SERVICES. The foregoing limitation of liability is in addition to any other limitations of liability set forth in this Agreement. All invoices are sent via email and it is your responsibility to keep your email address up to date. Anvil Web Services Manchester cannot be held responsible for invoices being sent to the wrong email address.
29.1 Please note that your account area is for reference only. To be entirely sure of when your domains expire, please check www.whois.com and it is down to The Client to make sure that the dates within their account correspond to the correct renewal date as shown on www.whois.com
This is because that in many areas, hosting accounts are downgraded and domains that are transferred in have different renewal dates.
29.2 All UK domain names may have different renewal dates to your hosting expiry date due to transfers, purchasing the name before hosting or changing the name mid way through a hosting term. It is down to the client to make sure that Nominet (www.nic.uk) have an up to date email address for your domain name, as you will be emailed by them if your domain name is out of sync with your hosting. All UK domain names will be renewed free of charge by Anvil Web Services Manchester as long as their hosting is up to date.
All the client would need to do if they receive an email from Nominet is forward it into us on office [at] anvilweb [dot] com and we will renew it for you as part of your hosting plan.
29.3 In regard to non UK domain names, once a renewal is paid for, your domain name will be renewed free of charge providing that the domain name has not entered redemption due to the customer renewing the hosting account late. If the domain name has expired before the hosting has been renewed, then the customer is liable to pay the fee applied by the registrar of £90 + VAT
29.4 Please make sure that all unwanted orders are cancelled from within your account area, otherwise your account could be suspended until that order is cancelled.
30. Service Guarantees:
Anvil Web Services Manchester.com guarantees 99.9% network uptime and server availability. This, however, does not refer to problems stemming from
Server Hardware Breakdown;
User error(s) or purposeful interruption(s) of the user service (e.g. if the client shuts his/her own server down, Anvil Web Services Manchester is not responsible for the downtime);
Failure due to software that is not explicitly supported by Anvil Web Services Manchester
If any hardware crash occurs that has been provoked by the customer then Anvil Web Services Manchester will either suspend a hosting account or terminate an account without warning. In these circumstances there will be NO REFUNDS of any monies paid to Anvil Web Services Manchester

Website Design Terms
Anvil Web Services Manchester terms for website projects are outlined below. These should help both parties when we work together. Please note that in some circumstances, usually dependent on the type or complexity of a project, sometimes a more extensive contract would need to be agreed. The following information on this page should give you a good idea of the terms between us. The following terms are solely for web design projects.
All Anvil Web Services Manchester websites are designed & configured as Mobile First. This means the website will automatically react to the size of screen that the website is being viewed on.
Before the Work Starts
A specification is agreed before any work on a project starts. This will be decided together and will be determined before a price is given for the project. If Anvil Web Services Manchester provide you with an estimate for work before a full specification is provided, this is only an estimate, not a firm price. The price may change when the full specification has been agreed upon by both parties. A full specification would normally need ALL website content to be provided to Anvil Web Services Manchester and the functionality agreed.
Once a specification has been agreed, a price and estimated start and completion date will be provided to the client; subject to deposits having been paid & cleared on time.
Website Content
The content of the new website in most circumstances is usually supplied by the client. Content means text, photo's, image's, video's, audio & any content that has been supplied to Anvil Web Services Manchester for inclusion into a website that is copyrighted, then the client MUST supply proof that they have the express written permission to use that content. If that written permission is not available then that content will not be included on the website.
Lead times
Dependent on workloads & at certain times of the year, a lead time to start a website project may be longer than the client would like. Lead times can shorten, & in some instances lengthen. In instances of a shortening lead time this can result in a website project start date being earlier than first anticipated. In these cases we will always contact the client who has been in contact with us first requesting a website project being undertaken.
Trading address for any website
Over the 25 years (1996 - yes, it's really been that long!) we have been designing, hosting & maintaining websites, we have been asked on countless occasions for the address not to be visible on the website. It is a legal requirement & any request is ALWAYS declined. The address visibility requirement applies to 99% of websites that we deal with, create or redesign. A fully validated trading address must be easily visible on any website. Anvil Web Services Manchester will not omit a business, sole-trader, charity or any other trading address, or address used for legal purposes. This is made very clear at the start of the drafting of a specification for any website project. Usually the address is visible in the footer of a website as well as the website contact page, Terms & Conditions page(s) & Privacy Policy page.

Deposit & Payments
Once a price is agreed by both parties, a 35% deposit will be invoiced. This invoice must be paid and cleared in Anvil Web Services Manchester bank account before any work commences. The initial deposit is only refundable if no work has commenced. Depending on the website project, the remaining 65% will be invoiced on completion of the website project. This payment is required regardless of the involvement of any other parties. The final payment of 65% must be paid within 3 days of our involvement in the project being completed and invoiced.
If the project takes longer than 28 days from commencement of work, we will ask for an interim payment(s) based on the work so far completed. All interim payment(s) will reduce the final 65% payment.
If, at any stage, the client changes what they want to be delivered and are not happy with the direction our work is taking you'll pay Anvil Web Services Manchester in full for the time we've spent working with you up until that point; & we would then agree to terminate the project.
Completion Date
Anvil Web Services Manchester make every effort to meet agreed completion dates. Sometimes, circumstances change & those circumstances may be out of Anvil Web Services Manchester & or the clients control. If for any reason Anvil Web Services Manchester cannot meet the agreed completion date Anvil Web Services Manchester will attempt to notify the client in plenty of time.
Any requests for additional work or changes to the project MUST be supplied in writing to Anvil Web Services Manchester by email. Requests for additional work or changes to the project specification after the specification is agreed, or are requested after the project has started, will impact the agreed completion date & agreed price. Any requests for additional work or changes to the project will be quoted for &, if agreed, will be invoiced in advance as an interim payment. If, for whatever reason, the client would like to move the completion date to an earlier time than agreed, a rush fee will apply, although this will be agreed before the rush work is started. In addition to testing and checks that Anvil Web Services Manchester carry out, it is the client's responsibility to check over the finished project.
Technical Standards & Testing
Anvil Web Services Manchester build the website to follow current web standards, & those standards fall within the agreed specification and budget. The project will be tested to support the latest versions of the following internet web browsers - Mozilla Firefox, Microsoft Edge, Opera, Safari and Google Chrome. If you require further browser support, this should be discussed with Anvil Web Services Manchester prior to the start of the project & may be included in the original quote and price.
Anvil Web Services Manchester test the site on Windows and Mac platforms. By default, all website project specifications are built to a Mobile First design, ie: a mobile device friendly design, more commonly reffered to Responsive Website Design. Anvil Web Services Manchester will test the live site on Android smartphone, tablet, and an Apple iOS device. Other testing can be arranged on request but that will add to the costs.
Anvil Web Services Manchester will make every possible effort to complete a design to your satisfaction. You are under no obligation to pay the final payment until which time you are completely satisfied with your site. However, if you decide that you no longer wish to work with us before the site is complete, your 35% down payment is non-refundable
Domain Names
Where the client does not currently own a Domain Name, Anvil Web Services Manchester can advise on the best type of Domain Name & also purchase one on your behalf. The purchased Domain Name is registered to you, The Client, & not Anvil Web Services Manchester. The price you pay is the price charged by the registrar used. The vast majority of our Domain Names are registered via Namecheap.
Website Health Check Service
Where a client requires a Website Health Check, Anvil Web Services Manchester will send an invoice for the full amount and this needs to be paid before we commence the work. There are no refunds.

Billing & Late Fee Policies
The short version
Bills are monthly
Hosting fees are due in advance and are billed on either monthly, quarterly or an annual basis
Payments are net 7 days. If a payment is 7 days late you will receive a Service Suspension email which advises that the service has been suspended until full payment of fees are paid, including any arears. Where a payment is 12 days late you will get a first & final Full Service Termination email which advises that the whole service will be terminated & all site content deleted in three (3) days, on day 15.
Once you receive this email there will NOT be any other emails sent warning of the consequences of a Full Service Termination. At that point in time the Full Service Termination occurs automatically starting at 00:01 on the 3rd day after the first & final Full Service Termination email. This is a fully automated system termination. Where a Full Service Termination has ocurred ALL website files, databases & all emails & their email accounts are NONE RECOVERABLE. Down payments are none-refundable.
The full version
All work completed by Anvil Web Services Manchester is billed on a monthly basis. Work includes design, site updates, website maintenance etc, but does not include hosting. Hosting fees are due in advance and are billed either monthly, quarterly or an annual basis. Hosting fees commence when your hosting package is created & NOT when your site goes live
Payment for all Anvil Web Services Manchester are due 5 days after the date on the invoice. The amount due is clearly shown on the invoice. If payment has not been received we will send you a friendly reminder email. Payments not received 10 days after the invoice date will cause your account to be considered past due and we will send an email or letter notifying you of a pending date of termination. If no payment has been received by the date stated in the termination email, your service will be disconnected. If your hosting accounts include email, this will also suspend your access to sending/receiving email. If payment (or payment arrangements) are not made within 60 days of the date of the original invoice all files, website pages, images, and databases (including emails on the server) will be deleted. If your account is deleted, Anvil Web Services Manchester has no obligation to provide you with a copy of your site content, or to restore your server access to enable you to obtain a copy of your site content.
In addition to the email reminders, we will also attempt to contact you regarding your late payment at once via phone before any account is terminated. If there is a reason for not remitting your payment in a timely fashion, it is your responsibility to notify us. We will entertain reasonable payment option requests in an attempt to prevent termination of service.
If your account does become terminated BEFORE 60 days past due you can restore your service by paying the following charges:
- £60 re-connection fee per hosted domain
- All past due balances MUST be paid & settled IN FULL - NO EXCEPTIONS
If your account does become terminated AFTER 60 days past due you can restore your services by paying the following charges:
- £150 and up - All site files, pages, databases will need to be re-created (deleted emails are non-recoverable); prices for this will vary depending on the size of your original site.
- All past due balances MUST be paid & settled IN FULL - NO EXCEPTIONS
