Acceptable Use Policy

Acceptable Use Policy - aka AUP

This Acceptable Use Policy, from here on in known as AUP, sets out the clients acceptable use usage between Anvil Web Services Manchester England and you, "the client", under which you may use our hosting services. This AUP applies to all hosting accounts, no exceptions!

Your use of our site means that you accept, and agree to abide by, all the policies in this AUP, which supplement our Website Terms of Use .

https://anvilweb.com is a website operated by Anvil Web Services Manchester, (“we”, “us” or “our”).

1. Prohibited Uses

You may only use your hosting services for lawful purposes. You and each authorised user may not use the service:

A In any way that breaches any applicable local, national or international law or regulation, including copyright or other intellectual property law.

B In any way that is unlawful, fraudulent or otherwise dishonest, or has any unlawful or fraudulent purpose or effect.

C To promote any unlawful activity.

D For the purpose of harming or attempting to harm minors or any other person in any way.

E For using your services in a way intended to harm our network, operations, business, equipment, websites or systems, or the reputation of our company or any other person or entity (including any denial of service and similar attacks).

F To transmit or procure the sending of any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam). Maintaining an open SMTP (Simple Mail Transfer Protocol) relay is also prohibited.

G To allow the use of our platform to provide free hosting to your customers because this encourages spamming and other abuses of the platform.

H To simulate communications from us or another service or entity in order to collect identity information, authentication credentials, or ANY other information (phishing).

I To knowingly transmit any data, send or upload any material that contains viruses or disabling code including trojan horses, worms, time-bombs, ransomware, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

J To represent or suggest that we endorse any other business, product or service unless we have separately agreed to do so in writing. In writing means one of two things; either a written letter sent via Royal Mail Signed For to the account holder we have on file, or via email to the email address that we have on file. Requests will only be accepted from a recognised Anvil Web Services account holder, no exceptions!

K To gain unauthorised access to or use of any computers, data, systems, accounts or networks of any person, business or charity anywhere in the world.

L In any manner which may impair any other person’s use of the services or use of any other services provided by us to any other person or business.

M To attempt to circumvent any password or user authentication methods of any person or business.

N In any manner inconsistent with our agreement or inconsistent with any instructions provided by us from time to time.

All Anvil Web Services hosting plans are intended to be used to host websites under your direct ownership - they are not reseller plans whether limited or unlimited. We reserve the right to withdraw support, terminate completely or suspend the service where such plans are:

O Used to effectively remarket our hosting services to multiple customers (whether you charge them or not).

P Used as bulk media sharing sites.

Q Used as backup storage facilities or for personal multi-media content such as movies, ringtones, music, photos or other media, or as an email archival system.

2. Communication Standards

Any data, information or communication made on or using the Services by any person must conform to appropriate and lawful standards of accuracy, decency and lawfulness, which shall be applied in our discretion, acting reasonably. In particular, you warrant and undertake that any data and each such communication shall at all times be:

A Submitted lawfully and without infringement of any Intellectual Property Rights of any person;

B Free of any virus (at the point of entering our systems);

C Factually accurate;

D Provided with all necessary consents of all relevant third parties;

E Not defamatory or likely to give rise to an allegation of defamation;

F Not obscene, seditious, vulgar, pornographic, sexually explicit, discriminatory, or deceptive;

G Not abusive, threatening, offensive, harassing or invasive of privacy;

H Not racist, sexist of xenophobic;

I Not liable to offend religious sentiments or deeply held beliefs; and

J Unlikely to cause offence, embarrassment or annoyance to any person.

3. Suspension and termination

Suspension of your services will normally occur automatically but on occasion may also occur manually in the following cases:

A Payment is overdue. We accept no liability should our inability to take a payment cause an account to become overdue. Please ensure you receive a payment confirmation on the expected date.

B Malware or other suspect content has been discovered in your hosting account.

C Spam or fraud/phishing email has been sent from your hosting services.

Notwithstanding the above, failure to comply with this AUP constitutes a material breach of the Website Terms of Use upon which you are permitted to use our services, and may result in our taking all or any of the following actions

D Issue of a warning to you.

E Issue of a request to remove email or other media from your account if your shared hosting account is determined to be over appropriate usage limits.

F Immediate, temporary or permanent withdrawal of your right to use our services.

G Immediate, temporary or permanent removal of any material from our services.

H Legal proceedings against you which may include, but not be limited to, recovery of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

I Notification to law enforcement authorities where we feel this is absolutely necessary.

We exclude liability for actions taken in response to breaches of this AUP. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

4. Updates to the AUP

We regularly revise this AUP from time to time by amending this page. You are advised to check this page from time to time to take notice of any changes we make, as they are legally binding on you as a client.
